Agreement to Terms
By accessing or using BARKULATOR ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.
Legal Agreement: These Terms constitute a legally binding agreement between you and BARKULATOR ("we," "us," or "our").
1. Description of Service

BARKULATOR offers:

1.2 What We Are NOT
BARKULATOR is NOT:
- ❌ A substitute for veterinary advice
- ❌ A medical diagnosis tool
- ❌ A veterinary telemedicine service
- ❌ A guarantee of health outcomes
- ❌ Endorsed by veterinary organizations

2. Eligibility and Account Registration
2.1 Age Requirement
You must be at least 13 years old to use this Service.
- Users under 13 are strictly prohibited
- We comply with COPPA (Children's Online Privacy Protection Act)
- If we discover an underage user, we will immediately terminate their account
2.2 Account Creation
To create an account, you must:
- Provide a valid email address
- Create a secure password
- Accept these Terms and our Privacy Policy
- Be legally capable of entering into contracts
You agree to:

5. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND.
We make no warranties, express or implied, including but not limited to:

6. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- We are NOT liable for any indirect, incidental, special, consequential, or punitive damages
- We are NOT liable for any loss of profits, revenue, data, or goodwill
- Our total liability shall not exceed $100 USD or the amount you paid us (currently $0)
Important: Some jurisdictions do not allow the exclusion of certain warranties or limitations on liability. In such cases, our liability will be limited to the maximum extent permitted by law.
7. Indemnification
You agree to indemnify and hold harmless BARKULATOR from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:
- Your use of the Service
- Your violation of these Terms
- Your violation of any rights of another party
- Your user-generated content
8. Termination
8.1 Termination by You
You may terminate your account at any time by:

Your continued use of the Service after changes constitutes acceptance of the new Terms. If you do not agree to the new Terms, you must stop using the Service.
10. Governing Law
These Terms shall be governed by and construed in accordance with the laws of your jurisdiction of residence, without regard to conflict of law principles.
Dispute Resolution:
- Any disputes shall first be resolved through good faith negotiations
- If negotiation fails, disputes may be resolved through binding arbitration
- Small claims court remains available for appropriate claims

These Terms, together with our Privacy Policy, constitute the entire agreement between you and BARKULATOR.

Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.
11.4 Assignment
You may not assign or transfer these Terms without our prior written consent. We may assign our rights without restriction.
